WEEE Regulations

Business IT equipment is classed as waste electrical and electronic equipment (WEEE). Under the WEEE Regulations it must not go into general waste. It has to be passed to an authorised operator for reuse, recycling or recovery, with the transfer documented.

UK GDPR and the Data Protection Act 2018

Personal data on redundant devices must be irreversibly destroyed, and you need evidence that this happened. The ICO can take enforcement action against businesses whose discarded devices lead to a breach. Certificates of destruction and per-device records are the accepted proof.

Environment Agency duty of care

Your duty of care means you may only pass waste to a registered Waste Carrier, and you must keep waste transfer documentation. If your disposal partner cannot show you its registrations, the legal risk stays with you.

How do you verify an ITAD collection is legitimate?

Check five things before any vehicle leaves with your data: the driver has photo ID; the vehicle and uniforms match the company you contracted; you receive a signed count of everything collected; every data-bearing device is labelled with its job number; and you know exactly when the certificates will arrive. If a collector cannot do these, stop the collection.

Who is liable if your ITAD provider leaks data?

You are. Under UK GDPR the data controller stays responsible even after handing devices to a contractor — the ICO fined an NHS trust after a disposal contractor resold unwiped drives, because the trust took the contractor’s claims on trust and never verified destruction.
